I’m having a problem with the Harley-Davidson dealer in Allen, TX and need some help solving it. I have purchased two used bikes from the dealer (HD of Dallas) in the past year. I purchased GAP insurance on both bikes, and requested a refund when I traded in the first bike. I have done this multiple times with vehicles, and it has never been a problem. I was assured by the salesman and the finance guy that the refund would get to me in six weeks. That was in mid December. I contacted the company who provided the GAP insurance, and they stated that the refund was sent to the Dealership owner on 01/10/2008. Suddenly, no one at the dealership knows anything about it and will not return my calls. I have now made two personal visits, called the finance guy three times, and called some mystery person named “Mary” who is supposed to handle these things, four times. I went to the dealer because the sales and service staff provide great customer service. However, they apparently change completely once the sale is done. I consider this a blatant theft, more than just poor service, and need to know what steps to follow next. I have contact Haley-Davidson corporate and filed a complaint, and have filed a complaint with the local Better Business Bureau. The company currently has an unsatisfactory BBB rating, but I’m not sure if it means much to them because they are not currently members of the BBB. I would appreciate it if anyone else knew of any actual state offices or agencies that I can file complaints with and attempt to get the situation looked at. I’m sure if they kept my GAP refund, then they are keeping refunds from others. Not everyone knows about the refund, and I believe the company is taking advantage of that fact.

HI; In WA. state you would call the state attorney General. If they get too many complaints the buisness gets it's licence pulled. Also most states require a bond attach their bond they can't do any buisness without one. At least here that is how it works. I have done this a couple of times you will get their attention. When you talk to them be calm and give them all the infromation you can. Back it up with times, names and dates that you have.Good luck ..scruffy..

You could recontact the company that provided the GAP insurance and ask them to send you a letter stating that the check was sent to the dealer and the date it was sent. Then take the letter to City or County prosecutors office and file a theft charge. When the dealer receives a court summons, he might unexpectedly find your refund.

Each state has and insurance commission that regulates the insurance companies and companies selling the insurance. You can find their 800 number listed under your state listings. One call is all it will take and your check will be in your hands very quick. Crezy
